Regarding Premier League content

The Premier League have sent us pretty much an ultimatum. Stop posting option files with Premier League content or they’ll seek compensation.
Now, as far as I am concerned, we as a website are doing nothing wrong. The files all contain content which can be edited by ANYONE in their game if they so wished. Also, the files are hosted ELSEWHERE and not on our servers. Furthermore, PESGaming does not create the files themselves and other users post them up on the forum. I therefore do not see in what way we (PESGaming.com) are infringing their copyrights.
HOWEVER, I am not in a financial position to pursue any sort of legal action that may come against us. So with that in mind, I have no choice but request that files with Premier League material are not published here… for the time being at least until I can discuss the matter fully with the Premier League directly.

Theres really nothing we can do at all, But what i will say is that it makes the Premier League look like utter stupid twats, who should be very very ashamed of thereselves for bringing something like this up!. If it was that serious Konami wouldnt have even included a edit mode in PES2008. What I mean is, you support these files, as in broadcast them. The Premier League, like it or not, has the right to defend its ‘merchandise’ and liscences. If Konami isn’t paying, I don’t believe there should be a loophole for getting the kit just because it’s isn’t the ‘official’ PES ones. You shouldn’t be pissed off at the Premier League, you should be pissed at Konami.
Well then it´s time to go to other websites. I´m not coming here again :)

EA has the fucking licenses for the premier league and perhaps other leagues too. It’s exclusive until 2010. That’s the deal with the fifpro or whatever. Konami could have all the money in the world they wouldn’t freaking get the licenses, it’s on the fucking paper. Haven’t you wondered how those ‘lazy asses’ got spanish and holland leagues all licensed but no premier league? what, they don’t feel like making some calls or something? get a grip. it’s not their fault. Anyway, premier league should just shut the hell up, like it’s posted, you can do what’s in the option files on your own and legally so publishing those is just like someone lending his legal work to others.
And I think pes 2008 sucks, they can do better than that and I think that you should blame konami on how pes 2008 sucks instead of the freaking licenses.

This is no suprise, the FA and the premier league are gready bastards. selling rights is what they do, they have to do this to keep the value of their exculsive contracts up. ENGLISH FOOTBALL is being milked for cash to feed the greedy vultures who benifit from it. LOOK what happened with the TV deal cash, This extra revenue has gone into the back pockets of greedy players, agents, hangers on. The money should have been pumped into grass roots football. Youth training schemes, inner city all weather pitches with qualified coaches for under privilged kids. better facilities at local comunity run clubs. english football will be on its knees in a few years and i cant wait, cos sometimes you have to go backwards to go forwards. rant over.
This is typical English FA and it F**ks me right off. The German league isn’t liscened but you don’t get them cryin about it when edit them in (except Bayern). This is just our FA getting scared about potentially losing out on future lucrative contracts from developers like EA for the rights to the premiership.Fat money grabbing out of touch W****rs..If they spent more time worrying about the state of our national game than game rights the English game wouldn’t be in the corrupt state it is now….

I waited all year for Pro Evo 2007… I even took the day off work on it’s release date… I’ve never been so disappointed in all my life. Less licenses, randomly freezing, in-game offline framerate discrepancies and don’t even get me started with the online games… As a hardened and formerly loyal supporter of Pro Evo, I can accept the lack of licensed english teams but that was something that was improving with every year. The thing that made it acceptable is the fact that the game left enough room on it for modders to create all the correct kits/emblems etc. Now that’s not even possible. It’s a shambles and it was a sad sad day for me when I removed it from my PS3 and made THE substitution…

And on top of that what’s with the shit soundtrack? Look at some of the music on FIFA and it completely pisses on Pro Evo. I know I’ve turned to the darkside but what’s the point in endorsing a once-loved brand when it doesn’t even listen to us westerners’ feedback. Instead of up-to-date indie tracks we get songs influenced by Pokemon. The only positive to take from Pro Evo 2007 in my opinion is the gameplay within the match itself. Frame-rate problems aside, the way the players control the ball and the tempo of the game is remarkebly better than it’s main rivals over at EA Sports. It has a ‘reality’ feel to it and Pro Evo has always encaptured that. But for me, as a total package that’s not enough I’m afraid. I’m now going to load FIFA 08 and watch 22 burns-victims play football. But at least these burns victims can wear my beloved Sheffield Wednesday’s blue and white stripes… OFFICIALLY!!!
The only good thing the Premier League has done financially is put Sheffield United back in the Championship. A little off-topic I know. All the best.

I have to say, I still play PES3,4 & 5 simply for the fact that elements of them are perfect for the series. I’ll be, honest it has taken me months to get comfortable with PES6, but I am now playing with a swagger France and Italy would be proud of! But PES2008 has bitterly disappointed me. The gameplay is okay, but when it comes to the fouling/refereeing tech in the game, it’s really taken a step back from 6.
As for the FA/Premier League, they obviously have nothing better to do than to bother the very football fans that keep them sipping Moet for breakfast. What would be a good gameplan for the FA/PL:
1) Stamp out Racism
2) Stamp out/clamp down on cheating
3) Cut out homophobia in the game
4) Demand that a fan website take any reference to the PL off the site
I can just imagine the meeting that took place for this little gem!
Okay, I’ve been very general about the FA/PL in the one sitting, but I have to say, I think Leeds Utd would be over the moon if someone had editted them into PES2008 right now (okay, not a prem team, but even so)!
the premier league dont own the copyright of club names.. they dont own the copyrights of club shirts.. thats all the edit is doing.. what content are they worried about coz the ps3 option file dont have the premiership logo or any club badges or shirt sponsors.. if we can edit the names of teams and shirts thru the games edit mode then nobody is breaking any copyright laws ..

Having played the demo for ages, I was a little concerned…. so for the first time in 7 years I bought Fifa 08, and I have tio say that its the best one theve produces and vu=isually stunning, yet there is response problems, and it doesnt FEEL like football, it relly doesnt, it doesnt feel like your kicking the ball, or passing it, it just hasnt got the proper feel that pro evo has, no Ive faced some massive negativity on here and WENB, and now a liitle bit into a master league with Lazio, its fantastic, real goals, real fight, its flipping fantastic, absolutely love it…. reallty really good, and it will get better, if Seabass could just buy the licences wed be there, its just that EA has tied up the licenses and they know that if they lose that then its over, they should just copy the gameplay and thed be able to push forward….

I don’t think there anything wrong with FIFA gameplay. It is more of a build up, passing football, while PES is about a fast pace, dribbling football. Two different styles, two different tastes. I personal prefer FIFA for my online play because I feel I earned the goals, while PES has a great manager mode. I think they are both good games this year.

I don’t understand why the FA would do this. I mean KONAMI (and EA) have to pay fort the licencs of teams because they SELL THEIR WORK. Giving something out completely free should be legal, I mean technically we bought the game, and edited the op in our own way and share it, what’s the big deal. Now, if there really is a problem, I’d go with PacMan’s Idea, except, in your option file, change all the names of the teams and league from FA to JA, and from Chelsea to helseac, and publish it with those names. It’s not like they have Pro Evo 2008, because if they did they should be thankfull that someone else takes the time to make these “masterpieces”. Oh yeah, one last thing, however has an iq of 6 and thinks PES 2008 Sucks because they have shitty PCs and can’t play it on high def, or because they don’t have an hd ready tv for the ps3 and Xbox 360 (PS2 Does Suck) shouldn’t even bother to visit pesgaming.com. And peter willis, keep supporting your files, it’s legal, they’re on another server. What is this, will tey accuse you of Telling Someone:”You know what, some people have option files, and these are located here:”?, I mean cm’on.
I have to say after being able to patch the game for the first time using memory cards on a PS3 I’ve been using the Premier League teams a bit more because previously I couldn’t be stuffed to use bloody Man Red and North London wearing shirts without logos.
So it’s back to using La Liga and Serie A teams I guess…

another thing i thought option files are like modding, its all unofficial bullshit that people (including myself) do all the time, end of the day these people are not making money from it, I am a little confused at their motive, if anything they just made themselves look very stupid.

I dont even understand why the FA would agree to let EA have exclusive rights to have all the fully licensed prem teams. you would think they would want all footy games to have it, cause for a start it would mean more money for them(as that is all they care about) plus more publicity for the Prem.
I’ve been sick of this whole licensing thing since pro 3, but at least with 3 you could change commentary names etc so you didnt have to play man red vs north london. Its the same with Football manager, they can get licensed premiership material because the makers of Championship manager have full rights.

The greedy Premier League care about nothing but their own big fat pockets, not content with getting NetResult to run a crusade against people posting videos of Premier League matches on YouTube, even those taken by people at matches on their own mobile phones, or taking pub owners to court for showing matches on foreign satellite TV channels to a public audience that they have paid said foreign television companies a “much cheaper than Sky” subscription fee, this latest campaign against PES editing websites really is the final straw. I’m so glad that I support a Football League team and tore up my subscription to Sky a long time ago, and with good bloody reason!
It’s like its a case of “Oh my god, your work contravenes intellectual property, that’s severely going to eat into our profits we’re milking by over-priced merchandising and all those broadcasting deals we made with the dozens of Asian/American/African television companies.”. EA’s possible involvement in this doesn’t help either, another company who I can proudly say I refuse to buy games for considering they bought out some of the best independent game production studios in the world and stripped them of their talent and kept the games series for themselves to rake more profits out of. I know FIFA is their own development but the exclusivity of some of the licencing deals really does take the pee.
The Premier League are England’s answer to the film and music industries of this world, raking in billions of pounds of profits at the expense of Joe Public and taking the “lynch mob” attitude towards us people who just spend our spare time making a community thrive by making add-ons for PES.
So that’s PESFan been threatened, now PESGaming, god forbid who the FUCKING VULTURES target next!
