It doesn't matter what you think you are. You are stealing content and reuploading it without permission, and content that is not free at that. Where you found it doesn't matter. I copied the relevant text from the creators themselves.

I can't just take a song by an artist, reupload it for others and tell them, hey, I think it's okay what I do because I upload it for free. What logic is that? My kits are in your pack and I want you to remove them.

It also doesn't matter how much time you invest to collect the work of others and present it as your own "nicoultras OF". The content you provide is available on the respective websites of the owners of that content and everyone can download it there without problems. There is no reason to grab that content and reupload it yourself, the only purpose behind it is that you want to be the guy people call "legend" around here and/or in other forums.

Content isn't always just free for everyone to take and for some reason many people in the PES community seem to have a serious problem grasping that content. Like I wrote in another thread: Things like this thread, reuploading other people's creations without their permission is what leads to creators leaving the scene altogether or not releasing their stuff publicly for free or at all. What you do is not "for the community", it actually damages the community. Even if some creators are okay with you using their content, others are not. And you can't just put them all in the same bag and say it's great for the community. What good is it if those people don't publish their stuff next year anymore because they feel that others use their content to be that one cool OF guy in some forum?

We just share files by the community and for the community.

And if you don't want something use you work, no share the work.
Keep the work only for your own use.

YOU ARE STEALING CONTENT THAT YOU HAVE NO PERMISSION TO UPLOAD ANYWHERE, is that not clear enough?! I don't care what Emerson Pereira does, because you are here and now, uploading content from a site that gave you no permission and that doesn't offer this content for free!

What I do with my own work is my decision, you on the other hand decide what you can do with the work of others! I uploaded my kits in this forum and I clearly stated that they are NOT allowed for usage in any OF! And this is the reward, you telling me what I should do with my work and what not, while you happily put my work in your great "nicoultras OF". That's really wow!

I stated my problem as clear as I can be multiple times now. I don't want my work to appear in an OF that is a wild collection of content from countless other creators. And that is a wish one should respect. I am a team member of two big PES fansites who offer content in a fashion that I support. And both of those sites clearly share their wish that their content is not allowed to be taken, collected, and reuploaded by other people.

I'm not trying to make money. My work is available for free on PESWorld. I just don't want others to use that for their own forum fame or whatever purposes. And it is entirely my right to say so, just as it is your right to call the people "rats" who provide the content you use in your own game to improve what Konami couldn't give you in the first place. All those fucking original content creators, right?!

Yeah, what's your point exactly? You're also using those violations of copyright in your game, don't you? I simply don't want other people to put my stuff in a package with their name on and make it available via their own means. And I simply asked nicoultras to remove a handful of files, I don't know why that is such an outrageous request.

If Borussia Dortmund wrote me that I should stop using their intellectual and visual property, than I would respect that and stop using it. But I dunno, I guess it's entirely inacceptable nowadays to ask someone to respect a simple wish of not having your content appear where you don't want it to appear.

I said before that the stuff in question is available for free and for everyone via easy download on the original site of the content. I'm not trying to make anyone pay for anything.

A free file that the creators don't want to see included in other collections and reuploaded somewhere else under a different name. As I stated lots of times by now. You as a moderator of a PES gaming forum should at least understand the general issue this whole argument is about.

Personally, I think if there wasn't any money involved, there wouldn't be an issue.

Not like he is claiming any works as his own..CLEARLY STATES AND CREDITS WHAT HE USED.....Go to YOUTUBE and police the ones that are claiming PES Universe files as their own.

Nico has been sharing his OF for years and credits whose work is in it.....down to even the smallest contributions.

Most serious editors credit those whose works they have used.

PES has and will always be a file sharing community........you bring money involved then you open the door on legalities.....Now i can see a loop hole if PES Universe was selling a thumbdrive......which happened to contain files. Easily to claim selling the thumbdrive.....But selling digital copyrighted content alone opens another door. And I hope that paid OFs will not be the downfall of OF's -- Because I am sure the FA, Bundesliga, and etc... would want their peice of the pie. You and I and everyone else knows that these paid digital OF's are on the wrong side of law due to copyright and licensing...think PES Universe would be better off selling a thumbdrive instead of straight digital content.

Guess that puts Nico wrong for using content that is not his and PES Universe selling content they really do not have the legal right to sell.

So I guess it is a wash?

Interesting post. Did you contact Borussia Dortmund and ask for permission to use their images and kit likeness when making the Dortmund kits?

Did you contact any of the teams with permission to make the kits or sponsor companies about their logos?

So you bitch at Nico for using your kits but I guarantee you did not contact one team to use their kit likeness when making the kits.

Like I stated in previous reply, being on wrong side of the law and these paid OF's will be downfall of OF's.

I'm not speaking for PESUniverse here. I quoted their FAQ text as an example of one of the bigger providers of OFs who have a problem with what Nico is doing. In the past, OFs like Nico's have been troublemakers in terms of having hundreds of duplicate players in them because of the use of the same players as bases for edits, low-quality kits etc. which led to players shouting at OF providers for stuff they weren't even responsible for.

This isn't about spoiling the fun for anyone. But I didn't like the mish-mash of an OF nico collected and uploaded over the past years, and I don't want to be associated with it. And I'm not trying to disrespect Nico or anything, but I don't see why he should be hailed as a savior for the community when all he does is gather stuff from others and post it as his OF.

Apparently he asked all the other creators for their permission, though, so it should be no problem to just replace the files. There are other Bundesligas out there, more than enough.

And again, this is not about money. This is simply about not wanting one's contribution to end up where one doesn't want to see it end up. If you want my Bundesliga kits, for example, you can grab them at PESU and PESW, because I know that their content is quality and has no greater flaws. I don't know about Nico's quality but that doesn't change that I hopefully am allowed to appear here with the simple wish of having him delete a few kits, or with the simple request of "please ask before taking", which is basic and common decency.

Of course I didn't ask. But if a complaint came in, I would at least listen and respect that instead of replying "well i think i'm right".

But sorry, I didn't wanna make such a huge issue out of all of this. I was hoping that this could be resolved by asking for kit removal and maybe getting an answer along the lines of, alright i can replace them.

Seems like the community feels more inclined to shit on the actual content creators, though, which is unfortunate. So just ignore what I wrote, I learned my lesson and won't bother you any longer.
