Consumers have filed a lawsuit against EA and its exclusivity deals on sports titles, and now the case is headed to court.

In 2008 a group of consumers sued EA due to an "unlawful and anticompetitive series of exclusive agreements with the National Football League, the NFL Players Union, Arena Football League and the National Collegiate Athletic Association." Four years later the lawsuit has been approved and will be heading to court.
DarkZero reports that the basis of the lawsuit is as follows:

"Through an unlawful and anticompetitive series of exclusive agreements with the National Football League, the NFL Players Union, Arena Football League and the National Collegiate Athletic Association ("NCAA"), Electronic Arts has driven its competition out of the market for interactive football software, including most significantly Take Two Interactive Software, Inc., the maker of the interactive football software title NFL 2K5 and has prevented additional competitors from entering the market."

The class action has been raised on behalf of any US resident who purchased a copy of any of EA's football titles on any platform from January 1 2005 to June 21 2012.

The consumers are not looking for a large payout from this lawsuit, but rather want EA to cease seeking exclusivity deals for its football titles. This is an interesting case, and we will keep you updated as we hear more.

EA has denied any liability or misconduct.

If EA loses this case then maybe we will see full licensed PES teams in near future and that means lot better sales for PES.

Not necessarily. Even if they were able to get a full license, will there be as many teams as in Fifa? Will Konami be able to add all the Champinship, League 1, Secunda, Serie B etc? In fact, would you trust them to be able to accurately research the lower teams and come up with realistic player ratings, given that they can't even come up with decent ratings for the major players?

Most of people I know in reality and over the internet who are playing FIFA over PES stated that they chose FIFA because they couldn't take their team being named North London,London White etc.

no they play fifa cos its better online


online is all people give a shit about in games , plus no kid will ever buy pes when fifa has everything , a 5 year old would only know what fifa is

With 2-3 divisions for major countries, and a host of other country divisions there is no way they can store images of all those players on a disc. Hence why I think I see a good number of generic faces in FIFA for some players. For instance, last year's horrible looking Anontio Valencia is this year's Nuri Sahin. But I don't think they are being cheap, just no more room on the disc. PES does not have to worry about storing that many players so can direct more attention to the fewer players they host on their disc. Of course the graphics mode is so different between the two as well....perhaps PES style consumes more memory per player as well.

EA is closing on the end of their latest exclusive contract with the NFL. Most of us hoping the NFL opens it up so Take Two can have a chance again. Madden has been excellent but I wouldn't mind seeing some competition after 13's patch fiascos.

blu ray has well enough space , xbox would be a 10 disk job , the lack of faces is a licence issue and time

but EA has had many years to get faces like Jones and Evans correct. They can't be lazy about it still.....can they? They only have to lock it down once. I have to think there is a space issue

A be on more disks for xbox
B on a dual blu ray disk for ps3


the reason is licence issues or if they have the licence they don't have time so they copy and pasted last years faces

Amen to that brother, this year was the first year I sold Madden within 2 weeks of buying it. Would be great if we could see the 2K nfl games on our tv's again!

There may well be an issue other than laziness, but it's very unlikely to be disc space. In the PS2 days PES only used to take up about a third of the space on a DVD - there's no way in hell these games are pushing the limits of what you can fit on a Blu-Ray.

I listened to a podcast interviewing EA about FIFA13. It was amazing to me how EA explained the legalities of adding European 1st season to their career mode. Seems like there were some legal issues to even sim the CL they had to get through and negotiate. In Euro 1st season, a draw of teams are added somewhat randomly. However, there are bunch of teams that would never be in a CL tournament. But then, you have the ability to draw a second time with one button click with more realistic teams that is darn close to the CL teams in this year. That little flick of the button seemed very much to me as a sneaky way to get around the legal issues EA may have encountered with 1st season. You can choose to one click again but I haven't gone a third time. Of course you can then substitute any teams after the draw so as long as a country's league is included enough times you can mimic the actual CL tournament. but back to my original point, just amazing the detailed legalities these companies deal with in the weeds.

They aren't 15 year old kids but when asked upon what do they find better in FIFA their reply was mainly licenses,Goal net movements,Music,Their friends chose FIFA too,better commentry blah blah blah.... no one has ever ever replied that any of the FIFAs have more depth in gameplay than PES does or that players contrast is better in PES depending on how their overall physique,speed,skills in real life.
I think PES online is better more depth in gameplay,more freedom,better Player IDs so I am happy to stick with PES.

Honestly speaking I don't think DVD space is a problem for EA its just that their engine is shit!the overall lightening is just not good enough.neither is the detailing of players looks/IDs.(that is character modelling)
That is what EA does with COD as well... They copy buildings out of previous edition of COD and stick it in maps of their new COD.
EA are solely a business company..... all they care for is money money money.

I think it was 2004 when I read one of the EA's employees interview about how they don't want to bring drastic changes to FIFA every year because if they would ,they would kill off their sequels by covering up all the changes in one edition itself.

Also about implementing 2-3 divisons well I don't care about it much but it is again a marketing gimmick by EA I think....for example a die hard division 2 club fan would want to buy FIFA over PES just because they could play league season with their clubs.Whereas PES cares more about quality over quantity.

Here in India they sell FIFA with one of the Indian star Sunil Chetri's(who is playing in UK)poster on it and I know Indians from Massive gaming forums who went gaga about it also India is a playable team and that has helped FIFA sell a lot.(so basically EA is thinking include India in the next edition of FIFA and it improves the probability of selling FIFA in India ...another marketing gimmick IMO)

There is no problem at all in including lower leagues clubs to bring more fans to the game, even konami should do this, i have read many many PES fans asking for this, and it is not a huge task either, just take any manager game and reflect the stats then put generic faces and you are done. lazy Konami.
Hell how they dared to remove league mode.

I work with 3D animation stuff and I can assure you that designers are Konami put in a lot of effort to replicate real faces.FIFA's character models are nothing compared to that of PES.
Stats? yeh but again Player ID for players of lower leagues with overall rating of 50 and 55? hmmm sounds tough...

I said they should put generic faces so no need to put efforts on that. Also how many players do you think Konami included in their player ID? I remember reading 50 players only. So essentially most of the players have no player ID.

Yeh I have been playing FIFA every year and I think definitely PES's gameplay has more depth than that of FIFA.(In FIFA you can run 6 feet to left and 6 feet to right and 6 feet to left again with the right analog stick without a shorter stride....... that is irrational)

I am not saying Konami doesn't care about money ,at end of the day Konami is in the entertainment industry for money too, but atleast they aren't trying to milk out every single cent for every improvement every year by releasing nearly the same game with outdated graphics,lightening or by trying to sell their gold packs or whatever to 16 year olds.

It is not everyone's belief that drastic changes to PES is killing the series.this years PES's reviews certainly suggest so.

I am not blind neither biased who wouldn't in their right frame of mind would want to play with their national team in any game? but I am stating a fact here that India's national team is shit at football ...why half-heartedly introduce bunch of teams,players to their game? it is obvious that they see it as a marketing gimmick.

First, Player ID is a feature of simulating player's way of movement and style of running, shooting, passing and so on, this feature requires capturing and watching a lot of the player videos to duplicates his style in the game which surely would consume a lot of time and efforts. So Konami have modelled 50 players only this year (the like of CR.7, Pirlo, Messi & other famous players) and will keep adding more players to the list every year as they implied (Konami).
So one of next year's features is (EXTENDED PLAYER ID).
