Osbourne is suing Iommi for a 50 percent interest in the "Black Sabbath" trademark, along with a portion of Iommi's profits from use of the name.

The Manhattan federal court suit also charges that Osbourne's "signature lead vocals" are largely responsible for the band's "extraordinary success," noting that its popularity plummeted during his absence from 1980 through 1996.

Ozzy's suit follows one filed by Iommi in December 2008 against Live Nation. In that filing, Iommi claims the concert giant sold merchandise bearing the band's logo, despite the 2006 expiration of a merchandising deal, reportedly worth nearly $80 million. Soon after that agreement concluded, Iommi reclaimed the band's trademark.

Iommi's suit argues Live Nation continued to sell more than 100 items of merchandise featuring the band's likeness, name and logo, despite the receipt of cease-and-desist orders from the guitarist's camp. Iommi's suit seeks damages in the amount of three times the profits from the merchandise sales, plus a halt to the Black Sabbath product sales.

Iommi and Geezer Butler have both said some less than kind things about working with Osbourne in a new interview with Decibel magazine. The pair recently completed a new studio album as Heaven & Hell, the post-Ozzy version of Sabbath featuring vocalist Ronnie James Dio, and Butler said that working with Dio was much easier than Osbourne. He explained, "Ronnie's a songwriter in his own right — he's got tons of ideas. Whereas Ozzy . . . in the old days, he'd come up with a vocal line and I'd write the lyrics. Ronnie is 100 percent involved in both the musical side and the vocal side, and he writes his own lyrics as well."

Butler added that Osbourne didn't take him seriously as a songwriter, saying, "If we were with Ozzy and I came in with the killer riff of all time, Ozzy wouldn't even think of doing it because I'm not the guitarist and that's the way he thinks . . . That's why it was so bloody hard to write anything."

Butler said about Heaven & Hell's debut CD, "The Devil You Know", "If we'd written this album with Ozzy, we'd still be working on the first track."

Iommi added that there was a sharp difference between the singers live as well, saying, "It was great being with Ozzy on the road . . . but with Ronnie it's a lot different, because we go out and we know exactly what we're gonna be doing. With Ozzy, we didn't really know. It was touch and go sometimes on some of those early shows, whether he was gonna turn up, if he'd be able to sing, if his voice was gone, or what. We'd have to cancel shows, which Geezer and myself really hated. But with Ronnie, we've never canceled a show."

Heaven & Hell will tour Europe later this spring and summer, with North American dates scheduled for August.

Hmm. The 'Signature lead vocals' argument has some validity, but still I argue that it was Iommi that defined the sound, definitively.

I have to side with Iommi on this one (not just because i'm a guitarist myself ) but solely crediting the bands success on the lead singer is a farce. Yeah the bands popularity droped massively when Ozzy left, but still you've gotta remember that it was Iommi, not Ozzy, that come up with most of the riffs that feature in Black Sabbath's tunes. Including some of the most recognisable riffs in rock/metal history in Paranoid and Crazy Train.

I was just going to make a thread solely about this piece of news, but while writing I thought there should be a general 'Music news' thread, so it is now so.

I'm with Iommi on this one too. For me, he was the real star of Sabbath. I wouldn't be surprised if Sharon put Ozzy up to it. Not like he needs the money.

Big news for those of you who know who he is. For those who don't, he was a music producer who worked with the likes of Tina Turner, Ike Turner, The Ramones, John Lennon and I beleive hes in the rock and roll hall of fame.

I remember reading about this in 2003 and thinking nothing of it, but now its been brought back up again because hes been sentenced.

He'll be 88 when he gets out

I remember being really shocked at the time. One of the top producers in music history yet capable of that.

I watched a documentary on Spector the other year. He had a dodgy upbringing. I don't remember what his parents did, but it wasn't a pleasant childhood. He's been weird ever since. I remember a story of him holding a gun at someone in a recording studio, for not following his orders? A very disturbed man.

It was something to do with a part of Viva la Vida (not sure if it was a riff, or just a general part of soloing) that was apparantly stolen from Satriani's song If I could fly.

Nothing new has come out, mainly due to Coldplay's management, and how they never talk to anyone but Coldplay

It's the lead in Satriani/vocal melody in Coldplay and chord progression. I do notice some similarities. Satriani is one of my favourite guitarists, I'm not sure but can understand his argument.

Yeah he is one of the best, and I can understand where he's coming from, but do Coldplay seem the type of band to say, 'yeah, that sounds good, lets add it into one of our songs'. I doubt it.

Also hearing Papa Roach's new song (Has anyone else picked this up?) that they have a guitar part that sounds exactly like the piano part in Keane's Everybody's changing.

Quite amusing really if you think why the hell are Papa Roach borrowing from Keane

I'm sure a lot of artists/bands get inspiration from other work and, almost unknowingly, use it to inspire their own ideas. Hell I've even done it to some extent with some of my stuff (one of the demo's I sent you, the chords/chord progression is the same as a Jimmy Eat World song). Thankfully, no one owns a chord or progression, but when you blatantly rip off a melody, that isn't right.

But, with the millions and millions of songs that have been written, it's inevitable that occasionally you would get artists coming up with the same ideas as another, even without hearing the other's work.

Had a listen to that Papa Roach track. Whilst the riff is similar, it's played entirely differently to how Keane used it so it's not as contentious as Satriani and Coldplay's dispute.

Id say nearly 90% of Hip Hop instrumentals is sample based, but it is quite uncommon to hear people pissing their pants over it.
