(360) Using an OF - tampering? Xbox live ban?

Hey just thinking of buying the hardware to save an OF file to my xbox as its annoying me that i cant sort the emblems out n using the OF will be a two with one stone advantage cause itll sort out real names aswell as emblems.

Does it class as tampering? If it does has anyone used the OF on an LIVE account?

Or is it unlikely that youll be detected.

use an option file and then tweak anything so that you save it again and it will be classed as being yours
