I think it's becuse it's an "off the ball" incident. Clearly the AI has noted that the ball has been touched by the defender, which makes him in possession of the ball and the keeper taking out Ronaldo was not a part of this and overlooked as an accident

That a penalty man and i have never seen the ref making a mistake in pes2008.So they red does make mistakes sometimes so thats more realistic
