When I first started playing I had the same problem, everytime I went to tackle with X i gave away a free kick. Now I simply run with the player and try and run him off the ball by holding R1 or R2. It works well and you won't give as many free kicks away.
Running with the player, I had no idea. This is something for us to ponder.It does require some skills and correct timing to perform that. If anyone has further ideas on how to reduce the number of fouls in the WE9 , please do share it with us. Maybe it requires a bit of effort from us, who knows once we have mastered all the different techniques, this problem may just fade away.....

Also passive defending has it's advantages. Try holding off more, and closing passing lanes, see what the CPU does. They 'play' more now. So you can get interceptions easily. CPU dribbling is also better, so if you oer-commit you're going to be left for dead. And you may not be able to catch up with the player as easily now.

In my opinion people hold on the X button waaaay too much

Just hold off and only tackle when u are in front of your man. any other way will usually result in a foul.
In real life you dont really see one man chasing the guy with the ball all around the park..

I have tried some of the suggestions like trying to run them off the ball but it doesn't work as much because if you run into them or near to them to even touch them, it's a fricking foul, they drop so easy in this game and I am not even pressing the x button. I have also tried to hold off to see what happens, but all they do is waste time and pass the ball around (this is on 5 stars, i still need more points to unlock 6).

Even then, if you try to tackle them with the x button when you are in front of them, 50% of the time that I have played, it's a foul because you either get the ball (success tackle) or the player falls down and gets a foul even though it's blantantly a fair/good tackle.

It would be good if they included picking a referee where the range is from easy going to very strict.

Instead of using the X/R1 try sliding for a change. I have changed my style of play of late. My game is more cautious now. Also try releasing the R1 button when in front of your opponent. Contrary to my first post in this context, my foul statistic has improved dramatically as I get less aggressive.
